Cancellation and Refunds
How a booking is cancelled and what is refunded, under the Standard Terms for Domestic Travel.
Korea Fair Trade Commission · Standard Form No. 10020 (revised 30 August 2019)
What this page sets out
Cancellation and refund of a booking follow the Standard Terms for Domestic Travel (Fair Trade Commission Standard Form No. 10020). This page gathers the articles of those Terms that deal with cancellation and refunds; it does not establish anything different from them.
The exact wording of each article is on the Terms page.
Deposit and balance
On concluding the contract the traveller pays the travel agency a deposit of not more than 10% of the travel fee, and that deposit is treated as the whole or part of the travel fee or of damages.
The balance, less the deposit, is paid by the day before departure.
The travel fee is paid by card, account transfer, cash deposit or another method as agreed between the parties.
Cancellation before departure
Standard Terms, Article 13, 10
The travel agency or the traveller may rescind the travel contract before departure. The loss arising in that case is compensated in accordance with the ‘Consumer Dispute Resolution Standards’ published by the Fair Trade Commission. The Terms do not themselves set the rate of compensation by date of cancellation; that notification does.
In the following cases the contract may be rescinded without paying damages: where the purpose of the travel cannot be achieved because of a natural disaster, war, a government order or a strike or closure of a transport or accommodation operator; where the travel agency has not taken out mutual aid or guarantee insurance or deposited a business guarantee; where a relative within the third degree of kinship has died; where participation has become impossible because of illness or another physical condition; where the traveller’s spouse or a lineal ascendant or descendant is admitted to hospital for 3 days or more and discharge before departure is difficult, for that spouse or one carer; and where travel on the itinerary stated in the contract document has become impossible for reasons attributable to the travel agency.
Where the minimum number of participants is not met
Where the travel agency rescinds the contract because the minimum number of participants has not been met, it notifies the traveller at least 24 hours before departure for a day trip, and at least 48 hours before departure for travel of two days or more.
Where it rescinds without giving notice within that period, it refunds the deposit already received and, in addition, compensates the traveller in an amount equivalent to 100% of the deposit.
Termination after departure
Standard Terms, Article 15, 10
Where there is an unavoidable reason, either party may terminate the travel contract after departure. Where that reason arose through the fault of one party, that party compensates the other party’s loss.
Additional costs arising from termination are borne by the party to whose circumstances the ground belongs; where it belongs to the circumstances of neither party, each bears 50%.
Where the travel is seriously defective and the defect is not cured, or performance in accordance with the contract cannot be expected, the traveller may terminate the contract, and the travel agency then loses its right to claim the price. Where the traveller has obtained a benefit from the travel performed, that benefit is reimbursed to the travel agency.
Where, after departure, the traveller does not receive a service included in the travel fee such as accommodation, meals or sightseeing for reasons of their own, no refund of the corresponding fee may be claimed. Where the travel ends part-way through, Article 15 applies.
When a refund is settled
Where a change of travel conditions increases or decreases the travel fee, the amount arising before departure is settled and refunded before departure, and the amount arising during travel within 10 days after the travel ends.
Damages arising from rescission or termination of the contract are settled within the same periods.
Where the travel is defective
Where the travel is defective, the traveller may request cure of the defect or a reduction of the price, and may claim damages in place of or together with that request.
This right may be exercised during the travel period as well, and must be exercised within 6 months from the day the travel ends.
Where a separate agreement applies
The travel agency and the traveller may make a special agreement in writing to the extent that it does not contravene the relevant statutes. In that case the travel agency explains that the content differs from the standard form and takes precedence over it, and obtains separate confirmation.
Changes to and cancellation of a booking are subject to the individual conditions agreed separately alongside the Standard Terms for Domestic Travel.
